1. Agreement

These Terms of Service govern your use of the Jeremiah's Pick Coffee Co. online shop at https://jpcteam.com and of the Jeremiah's Pick app for iPhone and Android (together, the "Service"), operated by Jeremiah's Pick Coffee Co. of San Francisco, California ("we", "us"). By using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. Purchases through a wholesale account are governed by our Wholesale Terms of Service instead.

2. The Service

The Service lets you browse and buy coffee and related goods, manage an account (orders, addresses, payment methods and preferences), subscribe to recurring deliveries, and read our content. Browsing needs no account; buying, subscriptions and order history need one.

3. Your account

• You must be at least 18 years old to create an account, and you must give accurate information and keep it current.
• You are responsible for keeping your password private and for activity under your account. Tell us at [email protected] at once if you suspect someone has used it.
• You can delete your account at any time in the app or on the website; the steps are published at https://jpcteam.com/shop/delete-account. Our Privacy Policy explains what happens to your information.

4. Text messages

If you ask us to text you a sign-in code, or give us a mobile number for notifications, our Text Message Terms apply. Agreeing to receive text messages is never a condition of a purchase.

5. Orders, prices and payment

• Prices are in US dollars. Sales tax is calculated at checkout from your delivery address.
• Payment is taken by our payment processor on its secure page when you place your order. You confirm that you are authorized to use the payment method.
• Your order is accepted when we send the order confirmation by email. We may cancel an order that appears fraudulent, contains an obvious pricing error or breaches these Terms; we refund in full any amount already collected for a cancelled order.
• Prices, products and promotions can change; the price shown at checkout is the price you pay.

6. Subscriptions and automatic renewal

A subscription renews automatically at the frequency you choose until you cancel, and your saved payment method is charged for each renewal. You can pause, skip a delivery, change products, quantity or frequency, or cancel at any time from your account on the website or in the app. A cancellation stops the next renewal; an order you have already paid for is still delivered, and your account shows the cancellation. We send you a reminder before a renewal with the renewal terms and how to cancel.

7. Shipping, returns and guarantee

Our Shipping Policy, Return & Refund Policy and Product Guarantee, published on our website, form part of these Terms.

8. Reviews and content you submit

Reviews and other content you submit must be your own honest opinion and lawful. You grant us a non-exclusive, royalty-free licence to display them with your display name in the Service. We may remove content that breaches these Terms.

9. Acceptable use

You agree not to use the Service unlawfully; attempt to access accounts, systems or data that are not yours; scrape or extract data by automated means; place fraudulent orders or make unjustified chargebacks; or interfere with the operation or security of the Service. We may suspend or close an account that breaches these Terms.

10. The app

• We grant you a personal, revocable, non-transferable, non-exclusive licence to install and use the app on devices you own or control, under these Terms and the usage rules of the store you downloaded it from.
• These Terms are between you and us only, not with Apple Inc. or Google LLC, and we, not Apple or Google, are responsible for the app and its content. Apple and Google have no obligation to provide maintenance or support for the app.
• If the app fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price of the app; the app is free, and to the maximum extent permitted by law Apple has no other warranty obligation for it. We, not Apple, are responsible for any other claim, loss or cost arising from a failure to conform to a warranty.
• We, not Apple, are responsible for addressing any claim by you or a third party relating to the app, including product-liability claims, claims that the app fails to meet a legal or regulatory requirement, consumer-protection or privacy claims, and claims that the app infringes a third party's intellectual property rights.
• You confirm that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on a US Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
• Updates are delivered through the App Store and Google Play. A version we no longer support may ask you to update before you can place an order.
• You must not copy, modify, reverse-engineer or redistribute the app, or use it on a device modified to bypass its security.

11. Intellectual property

The Service and its content, including text, images, logos, product descriptions and software, belong to Jeremiah's Pick Coffee Co. or its licensors. You may not copy, distribute or create derivative works from them without our written permission.

12. Product warning

WARNING: Coffee contains acrylamide, a chemical known to the State of California to cause cancer, which forms naturally during roasting. For more information visit www.p65warnings.ca.gov/products/food.

13. Disclaimer of warranties

The Service is provided "as is" and "as available". To the extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose, and we do not promise that the Service will be uninterrupted or error-free. Nothing in these Terms limits a warranty or right that cannot be excluded under California or other applicable law.

14. Limitation of liability

To the maximum extent permitted by law, Jeremiah's Pick Coffee Co. is not liable for indirect, incidental, special or consequential damages arising from your use of the Service, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

15. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Disputes will be heard in the state or federal courts located in San Francisco County, California, unless the law where you live gives you the right to bring a claim there.

16. Changes

We may update these Terms. For a material change we give at least 30 days' notice by email or with a notice in the Service before it takes effect. Continuing to use the Service after that date means you accept the updated Terms.
